1 and public entry onto the lands and waters under his juris2 diction within the preserve in accordance with the applicable 3 laws of the United States and the State of Alaska: Provided, 4 That he may designate zones where, and periods when, no 5 commercially related or recreational hunting, fishing, or 6 entry will be permitted for reasons of public health, safety, or 7 welfare, flora and fauna protection and management, sub8 sistence activities of the Tlingit community, or administra9 tion within the intents and purposes of this Act. The Congress 10 further recognizes that some of the uses on Admiralty Island, 11 such as wildlife photography and observation and hunting 12 may at times be in conflict with one another, and for this 13 reason so designates the Pack Creek and Swan Cove area, 14 within the boundaries of Pack Creek Research Natural Area as prohibited to recreational and subsistence hunting.

(b) Except in emergencies, any regulations prescribing 17 closure or restrictions relating to hunting, fishing, and public 18 entry shall become effective only after consultation with the 19 Fish and Game Advisory Committee of Angoon, which is 20 the appropriate agency having jurisdiction over hunting and 21 fishing activities. The Fish and Game Advisory Committee 22 shall consist of seven members, all of whom must be subsist

ence users and residents of Admiralty Island and possessing 24 such other qualifications as may be established by the Secre25 tary. Membership on the committee shall be determined by

1 popular vote at any regular or special election held in 2 Angoon, Alaska.

3 (c) Notwithstanding this section or any other provision 4 of this Act, members of the Angoon Tribes of Tlingit Indians 5 residing on Admiralty Island shall continue in perpetuity 6 their usual and customary use and occupancy of public lands 7 and waters within the preserve, including, but not limited to, 8 hunting, fishing, trapping, gathering of fruits and shellfish, 9 and the use of any nonendangered bird or animal species 10 for traditional ceremonials, regalia, and native arts and crafts. 11 SEC. 6. (a) Notwithstanding any other provision of 12 law and before entering into any contract for the establish13 ment of revenue-producing visitor services

(i) the Secretary shall offer to Kootznoowoo, Incorporated, a first right of refusal to continue providing such services within the preserve subject to such terms and conditions as are reasonable and appropriate;

(ii) before entering into any contract or agreement to provide new revenue-producing visitor facilities or services within the preserve, the Secretary shall first offer to Kootznoowoo, Incorporated, the right to build and operate such facilities, which right of first refusal to remain in force for a period of one hundred and twenty days. Should Kootznoowoo, Incorporated, respond with proposals that satisfy the terms and conditions established

by the Secretary, it will be awarded the contract. If

Kootznoowoo, Incorporated, does not respond with a 3 proposal that satisfies the terms and conditions estab

lished by the Secretary, the Secretary shall allow a reasonable period of negotiation, and if no satisfactory agreement is reached, the Secretary shall direct the National Park Service to provide such visitor services in accordance with the Act of October 9, 1965 (79 Stat. 969; 16 U.S.C. 20). No such agreement may be assigned or otherwise transferred without the consent of the Secretary.

(b) In order to assure that the Tlingit community of 13 Admiralty Island derives the maximum benefit from the 14 provisions of this Act, it is intended that visitor facilities and 15 services be located to the maximum extent possible on fee16 owned lands of Kootznoowoo, Incorporated.

SEC. 7. In furtherance of the purposes of the Wilderness 18 Act (78 Stat. 890), those certain lands in the Tongass 19 National Forest, which comprise about one million thirty 20 thousand acres (excluding the lands of the Kootznoowoo, 21 Incorporated, and the Village of Angoon), which are gen22 erally depicted on the map entitled "Admiralty Island Na23 tional Preserve (and Wilderness)", dated March 1977, 24 which shall be on file and available for public inspection in 25 the offices of the National Park Service, Washington, District

1 of Columbia, are hereby designated as wilderness and, there2 fore, as the Admiralty Island component of the National 3 Wilderness Preservation System.

4 SEC. 8. Congress shall appropriate such sums as may 5 be necessary to carry out the provisions of this Act. In the 6 construction, maintenance, and operation of any visitor fa7 cilities and in the operation of the preserve as a whole, the 8 local people will have priority in hire: Provided, That visitor 9 facilities must have accommodations for the aged and handi10 capped: Provided further, That Kootznoowoo, Incorporated, 11 shall, on its acceptance, be granted the right to operate, 12 administer, and maintain any federally owned cabins and 13 trails existing on Admiralty Island at the time of enactment 14 of this Act, under contract with the National Park Service 15 which provides that expenses of such operation, adminis16 tration, and maintenance shall be borne by the National Park 17 Service. Any funds donated by private institutions or indi18 viduals for perpetuation of the preserve will be used only 19 for the maintenance of lands and waters within the preserve. 20 SEC. 9. (a) As provided under section 22 (f) of the 21 Alaska Native Claims Settlement Act, as amended, the 22 Secretary and the Secretary of Agriculture are specifically 23 authorized and directed, if the shareholders of Kootznoowoo, 24 Incorporated, so elect, to exchange the timber rights to those 25 lands selected for the village of Angoon under section 16

1 of the Alaska Native Claims Settlement Act for timber rights. 2 elsewhere within the Tongass National Forest in areas not 3 designated as wilderness or wilderness study areas under 4 other provisions of law. If the shareholders of Kootznoowoo, 5 Incorporated, so elect, the timber rights to lauds selected by 6 the village under section 16 of the Alaska Native Claims Set7 tlement Act shall be conveyed to the Secretary. Within one 8 year of such conveyance, the Secretary of Agriculture shall 9 convey to Kootznoowoo, Incorporated, timber rights under 10 this section which are of equal value to those conveyed to

the Secretary. The conveyance of timber rights to the Secre12 tary shall be conditioned upon the conveyance to Kootz13 noowoo, Incorporated, by the Secretary of Agriculture of 14 timber rights of equal value under this section: Provided, 15 That if within one year of conveyance of timber rights to the 16 Secretary of Agriculture, said Secretary cannot identify 17 timber rights of equal value under this section by mutual 18 agreement, Kootznoowoo, Incorporated, at its election, may 19 either rescind the conveyance to the Secretary, or identify 20 not more than twenty-three thousand and forty acres of 21 land within the Tongass National Forest otherwise avail22 able for exchange under this section. The timber rights 23 in such lands shall then be conveyed to Kootznoowoo, 24 Incorporated, by the Secretary of Agriculture: Provided 25 further, That timber to which the Secretary acquires title
